New Regulation Establishes Requirements for Online Betting and Gaming Systems

On May 3, the Ministry of Finance, through the Secretariat of Prizes and Bets (SPA), published Ordinance SPA/MF No. 722. This ordinance, dated May 2, 2024, defines new technical and security requirements for systems betting platforms and platforms used by fixed odds betting operators in Brazil.
Compliance and Certification
Betting operators must now ensure the compliance of their systems and platforms with the standards set by the SPA, through certification by recognized bodies. This certification must be renewed annually and whenever there are changes to critical system components.
Data Location and Security
Betting systems and their data must be hosted in data centers in Brazil or in countries with an International Legal Cooperation Agreement with Brazil. These centers must have ISO 27001 security certification to protect the information controlled by the platforms. If operators maintain personal data abroad, the express consent of data subjects is required, in accordance with the General Personal Data Protection Law (LGPD).
Supervision and Inspection
The SPA will be responsible for supervising and monitoring betting systems, and platforms must ensure access to the information necessary for this purpose. Operators must provide data on their operations in accordance with specific regulations, ensuring transparency and compliance with regulatory standards.
Inspection Procedures
The ordinance details the supervision and inspection procedures that SPA will adopt, including inspections and requests for additional information from operators when necessary. In the case of online games, the regulations require the definition of multiplication factors for the amount bet and the use of random generators to determine results.
Rules for Betting at Physical Terminals
Rules for betting at physical terminals were also defined, covering bettor identification procedures and rules for payment transactions. These measures aim to guarantee the security and integrity of operations, in addition to protecting the interests of bettors.
The new regulation represents a significant advance in the structuring and security of online betting and gaming in Brazil, establishing rigorous standards for the operation and supervision of the sector.
